Petition asking SC to make “health” an exclusive Union subject rejected

THE Supreme Court Monday rejected a petition seeking directions to include”health” as a subject exclusively in the Union list and exclude it from the state list.

A two-judge bench of Justices L Nageswara Rao and Hemant Gupta said the court could not pass such a direction which is essentially the domain of Parliament.

Sujata Kohli, a former district judge, and the petitioner contended that the way states had mishandled the covid19 crisis, the “health” subject should exclusively be part of the union list.

Besides, the petition sought a direction to set up a National Health Commission for India.

The plea, however, did not find favour with the court which dismissed the plea with advice to the petitioner to approach the government with her suggestions.
