THE Rajya Sabha Wednesday passed ‘The National Capital Territory of Delhi (Amendment) Act, 2021’ which seeks to clarify that the expression “Government”, in the context of legislation to be passed by the Delhi assembly, would mean the Lieutenant Governor (LG) of Delhi.
With the passage of this Bill by the Rajya Sabha, it stood passed by Parliament as the Lok Sabha had already passed it on March 22.
The Bill also seeks to ensure that the LG is granted an opportunity to exercise power in select categories of cases and also to make rules in matters which incidentally encroach upon matters falling outside the purview of the Delhi assembly.
It provides that rules made by the Delhi assembly must be consistent with the rules of the Lok Sabha.
Reacting to the passing of the Bill, Chief Minister Arvind Kejriwal took to Twitter to condemn it. He said it is a sad day for Indian democracy.
“We will continue our struggle to restore power back to people. Whatever be the obstacles, we will continue doing good work. Work will neither stop nor slow down”, Kejriwal tweeted.

The Centre claimed that the Bill was in furtherance of the decision of the Supreme Court on July 4, 2018, and February 14, 2019, interpreting the provisions of Article 239AA of the Constitution relating to the structure of governance in the National Capital Territory of Delhi.
